Ness County Clerk Role

The elected Ness County Clerk is separate from the Clerk of the District Court. The County Clerk is useful for county-government records, election-related questions, commissioner records, and general county administration. The office is not the custodian of District Court case files, divorce decrees, probate orders, criminal cases, or court dockets. Those court records belong with the Clerk of the District Court.

Ness County Register of Deeds

The Register of Deeds is the county office for recorded land and instrument records. The official page identifies Brandi Reinert as Register of Deeds and Connie Schwindt as deputy. The office records and preserves deeds, mortgages, liens, oil and gas leases, plats, powers of attorney, UCC filings, and restricted military discharge records. Documents received after 4 p.m. are recorded the next business day, and most documents are completed and returned in 2-4 business days unless problems occur.

Request a Recorded Copy

Register of Deeds copies and certificates are separate from District Court certified copies. Use the Register of Deeds for recorded real-estate instruments and the County Clerk for county administrative records. The research documents copy fees for ROD records, but not a County Clerk administrative-copy schedule.

1. Identify whether the record is a county administrative record, a recorded land instrument, or a District Court case file.
2. For land records, gather party names, recording date range, legal description, document type, or book prefix when known.
3. Search the ROD online system or contact the office for in-person, mail, phone, subscription, or short-term access options.
4. Ask whether a plain copy, emailed copy, or certified instrument is needed.
5. Pay the documented ROD copy or certification fee, or ask the County Clerk for the current fee if the record is administrative.

Note: Court case documents still route to the Clerk of the District Court, even when a case involves land, liens, or an estate.

Ness County ROD Search Fields

The Register of Deeds publishes unusually detailed online access instructions. Documents present to 1988 are indexed and searchable by legal description and name. Date searches without dates run against all records from November 2004. Index images are scanned up to 2023, while later documents require a legal-description search and the "find now" function.

The fee schedule below comes from the official Register of Deeds research. It applies to recorded instruments and ROD copies, not court case copies. The County Clerk's separate administrative-copy fee schedule was not found in the assigned research.

Ness County Online Land Access

The Register of Deeds offers paid or subscription remote access through eSearch. Long-term access requires contacting the office for account setup. The research documents six-month access at $500 plus $0.50 per printed page and one-year access at $900 plus $0.50 per printed page. Short-term access is also documented.

• Long-term ROD access: six months is $500 plus $0.50 per printed page.
• Long-term ROD access: one year is $900 plus $0.50 per printed page.
• Short-term day access is $25.
• Short-term month access is $250.
• A 4.5% credit-card fee and $0.50 per printed page apply to short-term access.

DD214 and Restricted Records

Military discharge DD214 records recorded with the Register of Deeds are not open for ordinary public inspection. The research states that a DD214 request requires a completed request form mailed with a legible driver's license copy. Fax and email are not accepted. Access is limited to the service member, immediate blood relative, spouse, un-remarried widow or widower, children, siblings, parents, grandparents, another lineal descendant, or a licensed funeral director.

Recording requirements are also specific. ROD documents should be original, signed, include printed or typed names below signatures, be legible for scanning, include a 3-inch top margin on the first page and 1-inch margins elsewhere, and be properly notarized where required with visible seal and signature. The office cannot say whether title is good and clear; title examiners or abstractors use ROD records for that work.

Ness County land records also have a strong historical and genealogy use. The Register of Deeds research notes records back to the late 1800s, patent deeds signed by early presidents, land patent books, old county atlas books, oil and gas leases, town and subdivision plats, county school records, teacher records, military discharges, and powers of attorney. Those sources may matter in probate, farm transfer, mineral, or family-history work, but they are still county land and archive records rather than District Court case files.
